DMCA Copyright Policy

SYNCSWIM PRESENTS LLC (“Showcard”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) (“DMCA”), Showcard has adopted the following policy regarding copyright infringement.
1. Designated Copyright Agent
We have designated a Copyright Agent to receive notices of claimed infringement. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on Showcard, please send a written notice to our Designated Copyright Agent:

2. Requirements for a Valid DMCA Takedown Notice
To be effective, your takedown notice must be a written communication that includes all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner (“Complaining Party”).
- Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, including the specific URL(s) or other information sufficient to permit us to locate the material on the platform.
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
Notices that do not comply with all requirements of 17 U.S.C. § 512(c)(3) may not receive a response. Please do not send other inquiries or requests to our Copyright Agent.
3. Our Response to Valid Takedown Notices
Upon receipt of a valid DMCA takedown notice, we will act expeditiously to remove or disable access to the allegedly infringing material. We will notify the subscriber who posted the material of the takedown.
4. Counter-Notification
If you believe that material you posted was removed as a result of mistake or misidentification, you may file a counter-notification with our Copyright Agent. A valid counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed and the location at which the material appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the district in which your address is located (or, if outside the United States, any judicial district in which Showcard may be found), and that you will accept service of process from the Complaining Party or their agent.
Upon receipt of a valid counter-notification, we will promptly provide a copy to the Complaining Party. We may restore the removed material no sooner than 10, and no later than 14, business days after receipt of the counter-notification, unless our Copyright Agent receives notice that the Complaining Party has filed an action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material.
5. Repeat Infringers
It is Showcard’s policy to terminate, in appropriate circumstances, the accounts of subscribers who are determined to be repeat infringers. We reserve the right to determine what constitutes a repeat infringer in our sole discretion.
